Firearm Transfer Denial & Unclaimed Firearm Policy
When a firearm transfer is initiated through our Federal Firearms License (FFL), all transfers are subject to approval through the required background check process administered by the Bureau of Alcohol, Tobacco, Firearms and Explosives and applicable state systems.
Background Check Denial
If a customer is denied during the background check process, the firearm cannot be released to the transferee under any circumstances.
The firearm will remain in our lawful possession as an FFL holder pending disposition instructions from the purchaser and/or the original seller.
Fees and Payment Responsibility
All applicable fees remain the responsibility of the customer, including but not limited to:
- Transfer service fees
- Background check fees
- Storage fees (if applicable)
- Return shipping and handling costs
Payment may be required prior to any further action, including return shipment or alternative disposition.
Required Disposition
Following a denial, the customer must provide written instructions within the timeframe specified by our store policy (typically 15–30 days) to arrange one of the following:
- Return of the firearm to the original seller (where applicable), or
- Transfer to another eligible recipient, consistent with all federal and state laws
No release or transfer will occur until all outstanding balances are paid in full.
Unclaimed Firearms / Abandonment
If a firearm remains unclaimed after the stated policy period and the customer fails to respond or make arrangements, the firearm may be treated as unclaimed property in accordance with applicable state law and our written policy.
At that time, we may take lawful action to recover outstanding balances, which may include:
- Continued storage of the firearm at the customer’s expense
- Return shipment to the original seller
- Sale or other lawful disposition of the firearm to recover unpaid fees
Any remaining proceeds after fees may be handled in accordance with applicable legal requirements.
Important Notice
Customers are strongly encouraged to respond promptly to avoid additional storage charges and disposition actions.
